Letter of Demand
The first step in the debt recovery process is to send a strongly worded legal letter on a Roser Lawyers letter head. A letter of demand on a legal letter head advises your debtor that you are serious about collecting the debt and if they don’t pay it then legal proceedings will then ensue which will only increase the costs of the debt (which includes interest and legal costs being added to the debt).
In our experience recalcitrant debtors will often respond positively once received a letter of demand which opens up communication and allows for prompt payment of the amount outstanding or at least a payment plan to be entered into.
Statement of Claim
In the event the letter of demand is ignored or rejected the next step in the process is to issue a statement of claim or complaint (as it is known in some states and jurisdictions) it is a legal document demanding payment of the debt outstanding and providing particulars of how the debt was incurred and that it is due and payable.

If the statement of claim is not defended once the expiration of 28 Days (for most states) or 21 days (VIC) you can instruct us to file for default judgment.
